ChanRobles Professional Review, Inc. (the “Company” or “ChanRobles Professional Review”), a Company organized and existing under Philippine laws, including its contractors, service providers and affiliates, value the confidentiality of personal data. This document details how the Company uses and protects personal data for the purpose of obtaining the consent of data subjects, in accordance with the Data Privacy Act of 2012 (DPA), its Implementing Rules and Regulations (IRR), other issuances of the National Privacy Commission (NPC) and other relevant laws of the Philippines.

As a potential enrollee or participant, employee, consultant, supplier, service provider, lecturer, scholar, or on the job trainee of the Company and/or the Company’s memory enhancement, accelerated learning, power reading and maximum comprehensionlecture video seminar series featuring Mr. Robert “Memory Man” Racasa, you are considered a data subject. Please read this document carefully to ensure informed consent.

  • What is Personal Data?

Personal data refers to all types of:

1. Personal information – “any information, whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual;”

Sensitive personal information – “personal information about an individual’s race, ethnic origin, marital status, age, color, religious/philosophical/political affiliations, health, education genetic or sexual life, legal proceedings, government issued identifiers and other information specifically established by an executive order or an act of congress to be kept classified;” and

  • Why does the Company collect personal data?

The ChanRobles Professional Review collects, uses, processes, stores and retains personal data when reasonable and necessary to perform its business processes and pursue its primary and secondary purposes effectively, safely and efficiently and in accordance with corporate policies and in order to comply with any requirements, rules, and regulations that may be imposed and/or implemented by relevant government regulatory agencies.

In particular, the Company will collect your data in order to allow you to enroll and participate in the Company’s online on-demand lecture video seminars and to enable you to take the said courses online.

  • How does the Company collect, acquire, or generate personal data?

ChanRobles Professional Review will collect personal data when you fill-up, accomplish, submit and/or transmit your registration form, answer questionnaires, surveys and company forms, etc., and/or submit your confirmation to the lecture video seminar series or courses and other activities and/or events ChanRobles Professional Review sponsors, and will generate personal data to provide you access to the programs, courses, activities, events and/or services or to payment, compensation, refunds, reimbursements and/or entitlements of its services.

E. How does the Company ensure that personal data is accurate and up-to-date?

Data subjects are primarily responsible for ensuring that all the personal data submitted are accurate, complete and up-to-date. From time to time, the Company requests updated data; it is important that subjects cooperate and provide the same.

The Company shall take reasonable steps to make sure that the personal data it collects, generates, uses or discloses are accurate, complete, and up-to-date.

F. With whom may the Company share personal data?

As a general rule, the Company does not and will not share personal data with third parties except as necessary for the proper execution of processes related to a declared purpose, or the use or disclosure is reasonable necessary, required or authorized by or under law.

In order to comply with the rules and regulations that may hereafter be imposed and/or implemented by relevant government regulatory agencies, the Company hereby declares that it may be required to share personal data with the said public authorities and/or their consultants and service providers.

For purposes of its activities and/or events, as well as in administering its plans and programs, the Company may share your personal data with its affiliates and/or service providers and consultants. However, said affiliates, service providers and/or consultants shall be bound under the proper Data Privacy Agreement and Undertaking and may only use personal data for the purpose disclosed in this document, and may not use it for any other purpose.

The Company may likewise use pictures, videos and/or recordings taken during interviews, events and/or official activities, launching, programs, ceremonies, etc., for documentation and/or use in its campaigns, promotions and/or business generation activities to ensure the viability, affordability and/or sustainability of its programs, projects and courses, as well as for use in its application for the renewal or continuation of its accreditation and its compliance to similar regulatory requirements.

G. How does the Company protect personal data?

The Company strictly enforces its Privacy Policy. It has implemented technological, organizational and physical security measures to protect personal data from loss, misuse, unauthorized modification, unauthorized or accidental access or disclosure, alteration or destruction. The Company uses safeguards such as the following:

  • Use of secured servers and firewalls, passwords and/or encryption on all its computing devices;
  • Restricted access only for qualified and authorized personnel; and
  • Use of passwords for data files in whatever format;
  • Keeping physical or hard copies of documents, if any, under lock and key; and
  • Strict implementation of information security policies and protocols.

H. Where and how long does the Company keep personal data?

Pursuant to its Data Retention and Destruction Policy, ChanRobles Professional Review stores personal data both in paper and/or electronic form such as data files (on the premises or in the cloud) and physical document storage facilities. Personal information and other data shall be retained for ten (10) years from the date of the relevant online course taken, in case of participants or enrollees, or the release of final retirement pay, or final pay, or upon separation in case of employees or lecturers, after which said data shall be erased in a secured manner, in the case of digital data, or physically destroyed in the case of hard copies.

Subject to applicable laws, rules and regulations, the data subject may request personal data to be deleted from the Company’s systems, databases and hard copies within a reasonable requested date.

I. What are the rights of data subjects under the Data Privacy Act?

Data subjects have the following rights:

Right to be informed;
Right to object;
Right to access;
Right to rectify or correct erroneous data;
Right to erase or block;
Right to secure data portability;
Right to indemnified for damages; and
Right to file a complaint.

ChanRobles Professional Review’s decisions to provide access, consider requests for correction or erasure, and address, objections to process personal data as it appears in the Company’s official records, are always subject to applicable and relevant laws and/or the DPA, its IRR and other issuances of the NPC.
